These terms cover your use of the WISP Generator, provided by Howell & Gibbs LLC. Using the site means you accept them.

What the service does

You answer questions about your practice. We generate a Written Information Security Plan as a PDF, drafted against IRS Publication 4557, IRS Publication 5708, and the FTC Safeguards Rule (16 CFR Part 314), together with a risk assessment and a remediation plan derived from your answers.

What it is not

This is not legal advice, and buying it does not make your practice compliant. A written plan is one requirement among several. The safeguards the document describes are the ones you told us you have — if an answer is inaccurate, or a safeguard is not actually in place, the document will say something untrue and you remain responsible for that.

We do not warrant that the document satisfies any regulator, examiner, insurer, or court, and we cannot promise a particular outcome in an audit or a claim. If your circumstances are unusual or the stakes are high, have a qualified attorney or compliance professional review the result.

Price and what you get

Updates and renewal

“Regulatory updates” means changes we make to the questions and the generated text when IRS or FTC requirements change. For 12 months after purchase you may return to the form, revise your answers, and regenerate your document against the current version at no additional charge, using the download link from your purchase. Because we hold no account or email address for you beyond your Stripe receipt, it is up to you to come back; we may use that receipt email to tell you about a change that affects your document, and for nothing else.

After 12 months, continued updates and the remediation tracker are offered at $99/year. That renewal is not on sale yet. When it is, it will be a separate purchase you choose to start: nothing renews automatically, and we will never charge a card again without you starting a new purchase yourself. Whether or not you renew, the document you generated remains yours.

Refunds

If the product is not what you expected, email hello@howellandgibbs.com within 14 days of purchase and we will refund you. You do not have to justify the request.

Your responsibilities

• •Keep your own copy of the generated file. We do not store one
• •Do not resell or redistribute the generator itself, or present it as your own product

Availability

We aim to keep the service running but do not guarantee uninterrupted availability. Because your answers live in your browser rather than on our servers, an outage does not lose your work.

Limitation of liability

To the extent the law allows, Howell & Gibbs LLC is not liable for indirect or consequential losses arising from your use of the service, and our total liability is limited to the amount you paid. Nothing here limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of the State of New York.

Changes

We may update these terms; the date at the top will change when we do. Terms in force at the time of your purchase govern that purchase.
